Terms and conditions
Using Book with Kamkejani? Read the booking, cancellation and refund policy alongside this document.
Effective date: 30 September 2026
1. Acceptance of these terms
These Terms and Conditions govern access to Kamkejani’s websites, dashboards, AI search, listing, contact-unlock, subscription, promotion, review and support services. By creating an account, publishing a listing, buying a Kamkejani service or otherwise using the platform, you agree to these terms and the Privacy Policy.
If you do not agree, do not use the service. Nothing in these terms limits a right or remedy that cannot lawfully be excluded under the Consumer Protection Act, 2012, the Data Protection Act, 2019 or other applicable Kenyan law.
2. Eligibility and accounts
You must be at least 18 years old and able to enter a binding agreement. Information provided to Kamkejani must be accurate, current and complete. You are responsible for safeguarding your password, verification codes and devices and for activity performed through your account unless caused by Kamkejani’s failure to use reasonable safeguards.
Each person or business should use a genuine identity and must not impersonate another person, create deceptive duplicate accounts, transfer an account without permission or allow a suspended person to bypass restrictions. Notify support@kamkejani.com promptly if you suspect unauthorised access.
3. Kamkejani’s marketplace role
Kamkejani is a discovery, information and contact marketplace. We help guests find stays, compare host-supplied details, receive AI-assisted recommendations and obtain verified host contact information. Unless Kamkejani expressly identifies a separate booking service, Kamkejani is not the owner, landlord, property manager, travel agent or accommodation provider and is not a party to the accommodation agreement between guest and host.
Hosts decide whether to accept an enquiry, set accommodation terms and collect accommodation payments. Guests and hosts are responsible for confirming the identity of the other party, the final price, dates, house rules, cancellation terms, payment instructions and suitability of the stay before committing.
4. Host responsibilities
A host must:
- Have authority to advertise and offer each stay and obtain any required owner consent, licences, permits or approvals.
- Provide accurate titles, photographs, location, prices, fees, amenities, capacity, house rules, availability and contact details.
- Keep availability current and promptly correct information that becomes inaccurate.
- Keep room inventory, manually scheduled bookings and connected external calendars current, and investigate calendar sync errors promptly.
- Disclose material conditions that could affect safety, accessibility, quiet enjoyment or the total price.
- Maintain the property in a safe, lawful and reasonably habitable condition and comply with tax, consumer, housing, public-health and other applicable obligations.
- Use guest information only for genuine accommodation, safety, support or legal purposes and protect it from misuse.
- Honour commitments made directly to a guest or clearly explain and resolve any change.
Verification, approval or visibility on Kamkejani does not transfer these responsibilities to Kamkejani.
5. Guest responsibilities
A guest must use the platform for genuine accommodation enquiries, provide accurate information, respect host rules and property, communicate lawfully and avoid harassment, spam or misuse of unlocked contact and location data. A guest should independently confirm the property, host, total price, dates, cancellation terms and payment recipient before sending money or travelling.
Guests must not copy, publish, sell, scrape or use host contact or exact-location data for marketing, surveillance, fraud or any purpose unrelated to a legitimate stay enquiry.
6. AI search, ranking, availability and verification
AI search interprets natural-language requests and compares them with available listing data. Recommendations, match explanations, confidence scores, duplicate checks and generated descriptions may be incomplete or inaccurate. They are informational aids, not professional advice, a guarantee or a substitute for direct confirmation.
For an individual stay, a host may reconfirm accurate availability at any time and does not need to wait 48 hours. Each fresh confirmation refreshes the stay’s age and confidence signal and improves its chance of appearing earlier in discovery. The latest confirmation shows “Available” for 48 hours. After 48 hours without another confirmation it changes to “Availability not confirmed” but remains discoverable until the administrator-controlled expiry period shown in the host dashboard and availability guide. At expiry it is hidden until reconfirmed. A stay marked “Booked” remains visible lower in marketplace ranking, its host-contact action remains available for future-date enquiries and Kamkejani AI does not recommend it as available now. Multi-room properties do not use this confirmation timer; their room quantities and scheduled calendar inventory determine availability. A manually scheduled booking blocks only its recorded date and time, and confirming availability releases only the current overlapping manual booking rather than deleting later scheduled bookings.
Imported and exported iCal feeds are convenience tools, not real-time booking guarantees. Sync intervals, provider rules and network failures can delay changes. Hosts remain responsible for comparing calendars, resolving conflicts and keeping sufficient room inventory.
“Verified”, “approved”, “contact verified” or similar labels describe checks completed at a point in time; they do not guarantee identity, ownership, safety, quality, legality, availability or future conduct. Promotional placement is labelled and does not buy a favourable AI opinion.
7. Contact unlocks, credits and Kamkejani payments
A contact unlock provides the access described at checkout, which may include a host phone number, WhatsApp action, directions or exact-location information. The applicable price, currency and access conditions are shown before payment. A successful unlock may remain available for a limited reopening period and should not be repeatedly charged where the platform recognises the same valid access attempt.
Payments for contact unlocks, subscriptions, promotions or other Kamkejani services are processed through the displayed payment provider. You authorise the provider and Kamkejani to process the transaction and related anti-fraud checks. Credits, promotional balances and free access have no cash value and cannot be transferred unless Kamkejani expressly allows it.
If a Kamkejani service is not delivered because of a verified platform or payment failure, contact support with the transaction reference. Refunds are assessed against the service purchased, payment status, access already delivered and applicable consumer law. Accommodation deposits or rent paid directly to a host are not Kamkejani payments and must be resolved with the host or relevant payment provider, subject to your legal rights.
8. Accommodation agreements and disputes
Any accommodation agreement is directly between guest and host unless a separate Kamkejani booking product expressly states otherwise. The parties should record the agreed dates, price, deposit, cancellation and refund terms, occupancy, house rules, check-in and check-out arrangements.
Kamkejani may provide communication records, feedback tools or reasonable support but does not control a host’s property or a guest’s conduct. We may investigate reports, restrict a listing or account, preserve relevant records and cooperate with lawful authorities, but we are not required to decide every private accommodation dispute.
9. Subscriptions, promotions and paid visibility
Paid subscriptions and promotions apply for the duration, price and visibility treatment shown at purchase. A promotion may increase placement frequency but does not guarantee impressions, enquiries, occupancy or revenue. Promotions must remain clearly distinguishable from organic or AI-ranked recommendations.
Unless the purchase screen states that a plan renews automatically, a plan ends when its paid period expires. Where recurring billing is offered, the renewal price and cancellation method must be disclosed before activation. Kamkejani may pause a promotion when a listing is unavailable, suspended, misleading or otherwise ineligible.
10. User content and licence
You retain ownership of content you submit. You confirm that you have the rights and permissions required to provide it and that it does not violate privacy, intellectual-property or other laws.
You grant Kamkejani a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, format, translate, display and distribute that content only as reasonably needed to operate, secure, improve and promote the platform and the relevant listing. This licence ends when the content is deleted, except for cached, backup, legal or audit copies retained for a limited lawful purpose.
Kamkejani may remove or limit content that is unlawful, misleading, unsafe, infringing, technically harmful or inconsistent with these terms.
11. Reviews, feedback and communications
Reviews and feedback must reflect a genuine experience and must not contain threats, hate, unlawful discrimination, private information, extortion, fabricated claims or undisclosed paid endorsements. Kamkejani may moderate, decline or remove content and may label or investigate suspicious activity.
Guest Safety Check lets a signed-in host search a complete international guest phone number for factual feedback previously submitted by hosts, or submit factual feedback from a direct interaction. The results are an additional safety signal, not a public blacklist, proof of wrongdoing or an automatic ban. Reporting-host identities are not shown in search results. Hosts must not submit insults, assumptions, medical information or unrelated personal details, and must make their own lawful hosting decision. A person may contact support to dispute, correct or request removal of a report.
Service messages concerning security, transactions, verification, listing status and account operation are part of the service. Marketing messages are optional where required by law, and you may opt out using the provided control without losing essential service communications.
12. Prohibited conduct
You must not:
- Break the law, facilitate fraud, misrepresent a property or use another person’s identity or payment method without authority.
- Harass, discriminate against, threaten, exploit or endanger another person.
- Circumvent contact-unlock, payment, security, rate-limit, access-control, suspension or verification systems.
- Introduce malware, probe vulnerabilities, interfere with the platform or access data without authorisation.
- Scrape, harvest, resell or systematically copy listings, personal data, rankings or AI output without written permission.
- Manipulate reviews, availability, analytics, referrals, promotion delivery or search ranking.
- Use the platform to advertise an unlawful, unsafe or unavailable stay.
We may preserve evidence and report suspected criminal or harmful conduct to the relevant authorities.
13. Safety and off-platform dealings
Exercise reasonable care before meeting, travelling or paying. Use traceable payment methods, verify the payment recipient, avoid sending money under pressure and report suspicious instructions. In an emergency, contact the relevant emergency services or law-enforcement authority first.
Moving communication or payment outside Kamkejani may reduce the records and support available through the platform. Kamkejani is not responsible for private arrangements it does not control, but nothing in this clause removes responsibility that applicable law places on Kamkejani.
14. Suspension, closure and recovery
Kamkejani may warn, limit, pause, suspend or close an account or listing where reasonably necessary to investigate fraud, protect users, comply with law, address repeated inaccurate information, enforce these terms or prevent harm. Where appropriate, we will provide notice or an opportunity to respond, but urgent protective action may be taken first.
Account or listing closure ordinarily creates a restricted 30-day recovery state rather than an immediate hard deletion. Active sessions are ended and public access is removed. Only an administrator may restore supported actions from the protected audit trail. Managers cannot erase audit history or apply a rollback. After the recovery window, an automated erasure/anonymisation process begins and ordinary rollback is unavailable, subject to narrowly retained legal, financial, safety, security, consent and audit records.
You may stop using Kamkejani at any time. Obligations concerning payments, privacy, intellectual property, liability, disputes and records needed for lawful enforcement survive closure where relevant.
15. Intellectual property
The Kamkejani name, logos, interface, software, databases, original text, design and compilation of content belong to Kamkejani or its licensors. These terms grant only a limited, revocable, non-transferable right to use the platform for its intended purpose. They do not permit copying the service, creating a confusingly similar product or using Kamkejani branding without permission.
16. Third-party services and links
Payment providers, maps, WhatsApp, social networks, analytics services and external websites have their own terms and privacy practices. Kamkejani is not responsible for an external service’s independent operation. A link or integration does not mean we endorse every statement, product or transaction offered by that third party.
17. Service availability and disclaimers
We aim to keep Kamkejani secure and available but do not promise uninterrupted or error-free operation. Maintenance, connectivity, third-party failures, emergencies or events outside reasonable control may affect the service. Listing information and user content are generally supplied by users, and AI output is probabilistic.
To the maximum extent permitted by law, the platform is provided on an “as available” basis. We do not guarantee that a listing, host, guest, recommendation, availability indicator, contact response, promotion or accommodation transaction will meet every expectation. This does not exclude an express promise made by Kamkejani or a warranty or consumer right that cannot lawfully be excluded.
18. Limitation of liability
To the maximum extent permitted by applicable law, Kamkejani is not liable for indirect or consequential loss arising from a private accommodation arrangement, user conduct, inaccurate host-supplied information or an external service outside our reasonable control.
For a claim directly arising from a paid Kamkejani platform service, Kamkejani’s aggregate liability will not exceed the greater of the amount paid to Kamkejani for the affected service during the six months before the event or the minimum liability required by law. Nothing limits liability for fraud, wilful misconduct, gross negligence, personal injury caused by negligence, breach of data-protection duties or any liability that cannot legally be limited.
19. Responsibility for claims
If your unlawful content, fraudulent conduct or material breach of these terms causes a third-party claim against Kamkejani, you are responsible for the reasonably proven loss and costs caused by that conduct, to the extent permitted by law. Kamkejani will notify you and allow reasonable participation in the defence where appropriate. This clause does not apply to loss caused by Kamkejani’s own breach or negligence.
20. Governing law and disputes
These terms are governed by the laws of Kenya. Before starting formal proceedings, contact support@kamkejani.com with the relevant account, listing or transaction details so the parties can try in good faith to resolve the dispute. If it is not resolved, either party may use the courts or another competent dispute-resolution forum available under Kenyan law. Consumers retain any mandatory right to approach a regulator, tribunal or court.
21. Changes and general terms
We may update these terms to reflect service, safety or legal changes. We will publish the revised effective date and provide additional notice where a material change requires it. Changes do not retroactively remove accrued rights. If a provision is unenforceable, the remaining provisions continue to apply. Failure to enforce a provision immediately is not a waiver.
These terms, the Privacy Policy and any service-specific terms shown at purchase form the agreement for Kamkejani’s platform services. If service-specific terms conflict with these general terms, the service-specific terms control for that service.

Book with Kamkejani — service-specific terms — 30 September 2026
Booking terms version: managed-bookings-2026-10-02-v6.
A. Two separate services
Contact Host retains its existing access, charging and unlock conditions. A directly arranged or guest-reported stay is not a Kamkejani-paid booking and does not create a booking-ledger balance. Book with Kamkejani is a separate service that guests may choose when enabled and its required payment facilities are ready. The administrator may require eligible hosts to offer that option or let hosts choose whether to participate. Mandatory host participation does not require guests to use it and does not remove Contact Host. The host supplies the accommodation; Kamkejani administers the booking and the payment/settlement steps expressly shown at checkout. Kamkejani remains responsible for its own service obligations. Verification is not insurance or a guarantee of the host's future conduct.
Simulator mode collects no real money, creates no promise of real accommodation and has no redeemable balance. General live booking collection, refunds and withdrawals are unavailable until their provider facilities are operational and the service is enabled. A separately labelled, explicitly authorised administrator-only staging payment mode may collect the real amount shown at checkout, subject to the configured test mode, solely to verify payment and refund operations; it is not an accommodation sale and creates no right to occupy a stay. The simulator is still not real money. Never send money outside the displayed checkout to activate a test booking or release a refund.
B. Dates, price and confirmation
Booking times use Africa/Nairobi (UTC+3). The standard rule is check-in from 10:00 and checkout by 10:00 on a later calendar date. There is no automatic grace period. Under the default host policy, checkout after 10:00 up to and including 18:00 adds half the checkout-date nightly rate; checkout after 18:00 adds that full rate. Hosts may instead set the standard times and fixed-KES or percentage late-checkout tiers disclosed before payment. Same-day checkout is not supported in this version.
The quote itemises each stay-date rate, applicable host discounts, room quantity, late-checkout charge, total, platform commission and cancellation rules. The accepted snapshot controls that booking; later host or administrator changes do not retrospectively raise its price or fees. Check the details and keep the booking confirmation. Guests may send requests to several stays. The exact requested dates need approval before the guest can choose that request and pay. At the host’s request, an administrator may record approval on their behalf; the booking record identifies the administrator. A request expires after 24 hours or five minutes before check-in, whichever comes first; approval gives up to a further 24 hours to start payment, subject to that same check-in cutoff. Unpaid requests can be withdrawn, declined or expire without a cancellation charge. Requests and approvals do not hold inventory. Availability and the current price are checked again when the guest chooses an approved request. Reservation requests and host decisions generate dashboard, email and SMS notifications. A quote does not reserve inventory. A time-limited payment hold may reserve the entire selected interval; only server-verified payment and booking confirmation make it a paid reservation. A redirect or payment screenshot is not confirmation. An expired or conflicting reservation must not displace another guest; a verified unmatched payment is placed in review for a full refund.
C. Cancellation policy
Ordinary guest cancellation is allowed strictly before 24 hours have elapsed after verified payment confirmation, only if check-in was more than 24 hours away at payment, and never after check-in starts. A shorter-notice or same-day check-in booking has no ordinary guest cancellation window. The dashboard displays the applicable deadline. For an eligible guest cancellation, the disclosed commission and cancellation fee are retained, capped at the collected total; the balance becomes due for refund. An unpaid hold has no collected amount to refund. Cancellation releases its reserved dates immediately; provider refund settlement is separate.
If the host cancels a paid booking, the guest is due a full refund of the booking payment without a deduction for commission, cancellation fee or host penalty. The host's separately disclosed fixed or percentage penalty becomes a host liability and may be recovered from eligible future booking earnings, subject to review and applicable law. A host must not pressure a guest to cancel to avoid that liability. Administrator cancellation for a service failure is not an ordinary guest cancellation. Contact support about errors, exceptional circumstances or a statutory remedy even when self-service cancellation has closed.
D. Refund policy and booking ledger
An approved refund remains pending until payment-provider confirmation. Refunds normally return to the original source; if the provider cannot use that source, support must verify the lawful recipient and document an appropriate alternative. Do not assume that a refund approval, withdrawal request or simulated transaction means money has moved. Provider delays and failures are recorded and communicated; no additional payment is required to unlock a refund. Contact support@kamkejani.com with the booking and transaction reference, never a PIN or password.
The booking wallet is an internal settlement ledger, not a bank account or a representation that Kamkejani operates a licensed escrow, deposit product or general-purpose transferable wallet. It pays no interest and does not support general top-ups or peer-to-peer transfers. Guest money for a future stay or refund is a settlement liability, not all earned Kamkejani revenue. For nightly stays, the host share for each completed night becomes eligible at the standard checkout time recorded in the booking, in Kenya time. Remaining nights stay held. The final balance, including any late-checkout amount, becomes eligible at the booked checkout. Hourly, same-day and older bookings without a saved nightly breakdown settle at their booked checkout. Open disputes, refunds, lawful compliance checks and disclosed host debts can prevent or reduce release. Earlier availability of host earnings does not reduce a guest's refund entitlement. Only available, unreserved amounts may be withdrawn; funds reserved for guest refunds cannot fund a host payout. Payment-provider fees, fraud, chargebacks or host debts can create risks and are not eliminated by this ledger.
E. Support, records and rights
Hosts must keep calendar inventory accurate and honour confirmed dates, including paid late checkout. Imported calendars are not real-time guarantees. Booking, payment, cancellation, refund and settlement notices use dashboard records and the enabled email or SMS channels; a delayed notice does not change the recorded transaction. Report an unavailable or materially misdescribed stay, fraud or payment problem promptly. Relevant funds may be held for an auditable human review. Account closure does not extinguish a booking, refund entitlement or lawful debt.
The full booking, cancellation and refund policy is at https://www.kamkejani.com/booking-policies. These service-specific terms supplement the general Terms and Privacy Policy and control conflicting general wording for this booking service only. No time limit, fee, liability limitation or dispute process removes a mandatory consumer, cancellation, refund, data-protection or other statutory right, or excuses Kamkejani's own legally required duties. The terms do not describe test transactions as a regulated financial service. Material changes apply to future bookings with fresh checkout acknowledgement, not retroactively to an accepted booking.
Managed-booking participation, reserves and payment disputes — managed-bookings-2026-10-02-v6
This versioned update applies to future booking checkouts and the expressly identified pilot. It supplements administrator-authored terms without deleting them and supersedes earlier managed-booking wording only on the matters expressly revised below. Previously accepted reservations retain their applicable snapshot and accrued rights; this update does not retrospectively impose a new fee or host debt.
Host participation and the guest's choice
The administrator selects either mandatory participation, requiring eligible hosts to offer Book with Kamkejani, or host choice, allowing each eligible host to opt in. These are marketplace participation rules, not permission to accept unavailable inventory or bypass verification and payment safeguards. Hosts receive the applicable rule and commercial terms through their dashboard. Guests may still choose Contact Host under its existing monetised access conditions. Neither participation mode makes a direct arrangement a managed booking.
Refund liabilities and platform liquidity
Guest refund liabilities must be separately identified in the booking ledger and excluded from host withdrawals, platform earned revenue and funds used to recover another debt. Operational segregation in the ledger does not by itself establish a separate trust account, licensed escrow arrangement, deposit guarantee or insurance.
Operational policy requires a platform-owned liquidity reserve funded by Kamkejani's own funds to support refunds and provider reversals where guest funds have already been paid out or provider settlement is delayed. The reserve is not funded by an undisclosed guest surcharge or by treating unrelated guest refund liabilities as available cash. No fixed reserve percentage, balance, automatic replenishment process or universal refund-completion deadline is promised by this version. An authorised administrator must review liquidity, reconcile provider evidence and arrange any required platform funding before approving a money movement. A reserve shortfall or failed provider transfer requires recorded escalation and accurate communication; it does not cancel a lawful refund obligation.
A guest's approved refund is not conditional on first collecting a host debt. A host cancellation continues to entitle the guest to a full refund, without subtracting the host penalty, commission or recovery costs. Kamkejani must manage its own liquidity and recovery separately rather than requiring the guest to pay again or wait for a host to replenish an account.
Chargebacks, reversals and disputed payments
Report a provider chargeback, mobile-money reversal, duplicate debit or booking dispute with the relevant transaction reference and evidence. An affected booking payout may be frozen for a proportionate human review. Support must reconcile the original capture, any earlier refund, provider reversal or chargeback, and outstanding liabilities before a further payment. A refund and chargeback must not both reimburse the same amount twice; equally, a provisional or disputed provider entry must not be presented as a completed refund. Provider-confirmed settlement and the final reviewed entitlement control the remaining amount due. A guest remains entitled to use lawful provider, regulator or court complaint routes.
The reviewer must record the reason for a hold, relevant evidence, affected amount, decision, provider references and any release or recovery. The affected host and guest receive an appropriate status notice through the configured channels, subject to lawful fraud-investigation restrictions. Unresolved or failed items must be escalated to authorised support and the provider as appropriate. A support deadline or request for evidence must not remove mandatory rights, and no automatic finding of host fault follows merely from a guest complaint.
Recoverable host costs and no double recovery
Only lawful, documented costs attributable to a host's breach, fraud, cancellation or other responsibility, and disclosed in the applicable accepted commercial terms, may be allocated to that host after review. Kamkejani's own error, breach or negligence must not be transferred to the host. A new charge cannot be invented after the booking. The reviewer must identify the contractual basis, evidence and amount, allow a reasonable opportunity to respond, and record any adjustment or waiver.
A cancellation penalty, recovered provider cost, previously withheld amount and later host payment must be reconciled so the same liability is never recovered twice. No recovery may use guest refund reserves or exceed the outstanding lawful host liability. Recovery from future eligible earnings is separate from a guest's refund and remains subject to the accepted terms and applicable law.
Simulator and restricted real-payment pilot
Simulator transactions use test money only and create neither a redeemable balance nor a real accommodation promise. If expressly enabled, a separate administrator-restricted staging payment mode may collect the amount shown at checkout in a clearly labelled real-money test. Payment methods, amount limits and authorisation requirements depend on the configured test mode. Its purpose is to check payment and refund operations, not to sell accommodation; no real stay, host payout entitlement or general live-booking availability follows. Real pilot payments and refunds must be recorded and reconciled separately from simulated events. The transaction must never be described as simulated after real money was collected. Refund approval is not provider-confirmed completion, and no automated refund or payout facility is implied where it is not available.
Existing booking rules and legal rights
The accepted dates, fees and pricing snapshot still control: default checkout is 10:00 with no grace period, after 10:00 through 18:00 is half the checkout-date nightly rate, and after 18:00 is a full rate unless the host disclosed different tiers before booking. Ordinary guest cancellation remains strictly before 24 hours after payment only when check-in was more than 24 hours away at confirmation, and never after check-in. The full host-cancellation refund rule is unchanged. All reviews, reserves, participation rules and recoveries remain subject to mandatory consumer, cancellation, refund and data-protection rights. Nothing excuses Kamkejani's own legally required duties. Escalation contact: support@kamkejani.com; full policy: https://www.kamkejani.com/booking-policies.

Stay reviews and disputes
Reviews are for genuine, completed stays. Contact feedback remains a separate process.
Who can review
Only a signed-in guest with a verified email or phone may review a stay they unlocked. The guest must choose “I booked this stay,” provide the stay dates, and have opened WhatsApp, a call or directions from that same unlock. Reviews are accepted after the stated checkout date and stay private while the host confirms the booking.
Host confirmation
The host has seven days to confirm the booking or dispute it with a specific reason. A confirmed review becomes public as host-confirmed. Hosts cannot delete reviews.
If the host does not respond
One unanswered review per guest may publish in a 30-day period after seven days as guest-reported, not host-confirmed. Repeat unanswered reviews from the same guest are held for moderation instead of automatically published.
Disputes and accuracy
A disputed review goes to authorised Kamkejani staff for a recorded decision and does not automatically publish while the dispute is open. A host may also dispute a public review with a specific reason; it remains public while staff consider that dispute unless staff remove it. Guests must write about their own genuine experience and provide accurate dates. Account, unlock and contact-action activity alone do not independently prove a booking.
Contact feedback is separate. All feedback choices require a signed-in guest account; anonymous visitors are directed to register or sign in before submitting feedback.
